The detention occurred last Wednesday, as Ernesto was apprehended without a warrant or significant justification, raising concerns about the enforcement practices of ICE across the country.

Ernesto, known for his involvement in the Teranga Academy and recognized for his academic achievements, was taken into custody despite presenting valid documents that confirmed his legal status in the United States. Reports indicate that ICE arrested his father outside a parking lot, compelling him to guide agents to their residence, setting off a series of events that led to Ernesto’s detainment.

This alarming incident comes amidst rising concerns regarding ICE’s practice of making warrantless arrests of legal citizens and visa holders nationwide. Ernesto has Special Immigrant Juvenile (SIJ) status due to prior instances of abandonment, abuse, or neglect, and he is additionally shielded from deportation through the Deferred Action program sanctioned by the Department of Homeland Security. Notably, he has no criminal record, pending charges, or deportation orders, casting further doubt on the legitimacy of his detention.

Over a span of five days, Ernesto was moved among three different detention facilities, complicating his access to legal representation. As of now, he is held at a detention center in Monroe, Louisiana. His legal team successfully established contact with him for the first time on Monday, but troublingly, ICE has not issued a Notice To Appear within the legally required 72 hours of his arrest, resulting in his detention without formal charges.

In light of these circumstances, a bond hearing for Ernesto has been scheduled for June 18 in Indianapolis, with the anticipated bond set between $15,000 and $20,000. Furthermore, community members and advocates have mobilized to support him; a GoFundMe campaign has been launched to raise funds for his bond and assist his family during this challenging time.

The community’s response has been overwhelmingly supportive, with Gary Fields, the superintendent of Bowling Green Independent Schools, expressing pride in Ernesto’s accomplishments and affirming that his legal status should have posed no issues. Staff at Teranga Academy, including a yoga instructor, have also voiced admiration for Ernesto’s character and contributions, describing him as responsible and a positive role model.

The incident draws attention to the broader implications of immigration enforcement policies, especially those that involve individuals who have legally navigated their residency processes.
